Introduction

These Terms of Service ("Terms") govern your use of Hwahae services owned and provided by Hwahae Global Inc., including our website, mobile applications, and any other platforms or services where these terms appear (collectively, the “Sites”). By accessing or using our services, you agree to be bound by these Terms, our Privacy Policy, and other applicable policies.

Hwahae analyzes cosmetic ingredients to provide information about product safety, efficacy, and skin type compatibility. It also allows users to view reviews from other users. Hwahae is committed to continuously providing valuable content, information, and services for your skin and overall health.

Intellectual Property and Copyright

Except for the logos and images of products from other skincare brands, all content on the Sites, including design, text, graphics, logos, button icons, images, audio and video clips “Content”) is protected by copyright and trademark laws. All software used on the Sites is the property of Hwahae Global or its software suppliers. Permission is granted to electronically copy and print portions of the Sites for personal use, such as placing an order or engaging with the Community. Any other reproduction, modification or distribution of Content without prior written permission of Hwahae Global is strictly prohibited. The Sites and all page headers, custom graphics and button icons are service marks, trademarks, and/or trade dress of Hwahae Global including the trademark and service mark “Hwahae” Diverse Services for Cosmetics, Skin Health, and Beauty Life

Hwahae offers the following services:

1. Analysis of Cosmetic Ingredients

• We analyze the full ingredients of various cosmetic brands based on credible institutions and sources, including the Environmental Working Group (EWG), the Korean Dermatological Society, the Ministry of Food and Drug Safety, and the book The Secret of Korean Cosmetics.

All Content and information are offered solely for personal, educational or informational purposes and are not a substitute for professional medical advice.

Any statements offered about products have not been evaluated by the United States Food & Drug Administration (unless otherwise specified), and any results reported may not necessarily occur in all individuals.

2. Cosmetic Ingredient Search Service

• A service that allows users to search and verify individual ingredients used in cosmetic formulations.
• Although we aim to provide accurate information, Hwahae assumes no liability for the accuracy of information on the Sites nor do we warrant that the product descriptions or other content on the Site are accurate or error-free. The Site's reference to any goods or services offered by other parties does not constitute an endorsement or recommendation by Hwahae unless specifically stated. We reserve the right to correct any errors, inaccuracies or omissions at any time and to change or update information at any time without prior notice

3. Cosmetic Review and Evaluation Service

• Users can write and browse reviews of cosmetic products.
• Hwahae may translate user-submitted reviews into other languages to improve accessibility for global users. These translations may be automatic or manually edited, and while we aim to preserve the original meaning, some discrepancies may occur. Translated reviews are provided solely for convenience, and Hwahae makes no guarantees regarding their accuracy.

4. Beauty & Health Content and Information

• Various beauty and health-related content and information are provided.

5. Advertising and Marketing Services

• Advertising agency services related to the operation and promotion of Hwahae.

You can access the above services on the Hwahae Sites. Because Hwahae’s services will continue to be updated, encourage you to check our service announcements for updates on newly developed features. The use of our services is at your own risk, and we encourage you to verify all details before making purchasing decisions.

Hwahae provides a limited license to access and use the Site for your own personal and non-commercial use. Unless otherwise permitted by these Terms, you may not copy, distribute, display, transmit, perform, modify, publish, or create derivative works from the Site or its Content.

Hwahae may provide software updates as necessary to improve its services. These updates may include the addition of important new features or the removal of unnecessary functions. We encourage you to keep your software up to date to ensure the best experience while using Hwahae services.

To enhance the Hwahae service experience, we may display various notifications, administrative messages, and advertisements within the service or send them directly to your registered email.

If you encounter system errors or any issues while using Hwahae services, please feel free to report them via feedback requests or error reports at any time.

Hwahae Account Usage

To access our services, you must create an account using either: a Google account through our integration with Google's authentication system, or an email and password combination.

By creating an account, you agree to our Terms and Privacy Policy. If you choose to log in using your Google account, you acknowledge that authentication is handled via Google OAuth, and we do not store your Google password. Hwahae does not allow account creation in the following cases:

• If someone attempts to create an account using another person’s identity, phone number, or email address.
• If incorrect, incomplete, or false information is provided during account registration.
• If the user is under the age of 14.
• If repeated identity verification attempts raise security concerns regarding personal data misuse.

If Hwahae determines that an account was created or modified in violation of these conditions, we may suspend or delete the account and restrict access to Hwahae services, either in full or in part. In such cases, Hwahae will notify you of the reason and the basis for these actions.

Important Guidelines for Using Hwahae

We hope that Hwahae helps you discover valuable information about the cosmetics you use and your skin’s needs, ultimately providing meaningful insights. However, please be mindful that Hwahae services must not be used improperly.

For example, the following actions are strictly prohibited:

• Disrupting Hwahae’s service operations in any unauthorized manner.
• Accessing Hwahae services through methods other than those officially provided.
• Collecting, distributing, or sharing other users’ personal information without consent.
• Using Hwahae’s services for commercial purposes without permission.
• Copying, modifying, or reproducing Hwahae content without authorization.

Intellectual Property Rights

• All intellectual property rights, including copyrights, of content created by Hwahae belong to Hwahae.
• You must not use information obtained from Hwahae for commercial purposes without prior approval.
• Copying, transmitting, publishing, distributing, broadcasting, or otherwise exploiting Hwahae content for profit is strictly prohibited.
• You must not reverse-engineer, modify, distribute, sell, transfer, lease, or attempt to extract the source code of Hwahae software or services.
• Posting unauthorized advertisements or promotional content on Hwahae without approval is also prohibited.

Consequences of Violations

If you violate Hwahae’s terms, policies, or relevant laws, Hwahae reserves the right to:

• Immediately remove or temporarily hide your content without prior notice.
• Suspend, restrict, or terminate your account as deemed necessary.
• Deny future access to Hwahae services, including restricting account re-registration.

By using Hwahae, you agree to follow these rules to maintain a fair and safe service environment for all users.

We Strongly Protect Your Personal Information

Protecting your personal information is one of Hwahae’s top priorities. Your data is used only within the agreed scope and for the purpose of providing Hwahae services. For more details on how we handle and protect your personal data, please refer to Hwahae’s Privacy Policy.

Service Disruptions May Occasionally Occur

Temporary service interruptions may occur due to system maintenance, updates, or technical improvements. In such cases, we will notify users in advance through announcements or main page notifications to minimize inconvenience.

In situations beyond our control—such as natural disasters, national emergencies, or system failures—advance notice may not be possible. If an unexpected service disruption occurs, Hwahae will take immediate action to resolve the issue and inform users via email as soon as possible.

Additionally, Hwahae may modify or discontinue certain services. In such cases, prior notice will be given. However, please note that users will not receive separate compensation for service changes or discontinuations.

Please note that some jurisdictions may not allow the exclusion of implied warranties and conditions, so some of the above exclusions may not apply to you but shall apply to the maximum extent permitted by applicable laws.

Hwahae May Use and Manage Review Content

You are solely responsible for all content that you upload, post, email or otherwise transmit via or to the Sites, including the submission of product Ratings & Reviews, Questions & Answers, and all other data (collectively, "Content"). We will not accept Content from you unless you are a registered user of the Sites and a member of Community.

. When writing and submitting a review, you agree to provide insightful, helpful details about why you like or dislike a product and avoid vacuous statements and ensure that the review relates solely to the applicable products or services offered on the Sites.

By posting a review or sharing Content on Hwahae, you agree that:

• Hwahae may use and modify user reviews for display and service-related purposes as described in this agreement.
• See the “Granting License for Review Content” section for more on usage rights.
• Hwahae may translate user-submitted reviews into other languages to improve accessibility for global users. These translations may be performed automatically or edited manually, and while we aim to preserve the original meaning, some discrepancies may occur.
• Translated reviews are provided for convenience only, and Hwahae does not guarantee their accuracy.
• Hwahae may display user-provided attributes such as country, skin type, skin tone, and skin concerns alongside the reviews for contextual relevance.

Additionally, Hwahae may share user reviews with third parties and other service partners for promotional, affiliate, or advertising purposes. In such cases, some modifications, omissions, or edits may occur.

User-Submitted External Reviews

If you voluntarily submit external content such as TikTok video links through Hwahae's features, you agree that:

• You are the original creator or have the necessary rights to share the content. Hwahae is not responsible for any copyright disputes arising from user-submitted content.
• Hwahae may display, publish, or link to the submitted content on its website and related promotional pages.
• Your content may contain personally identifiable information (such as face, voice, or username), and by submitting the content, you grant Hwahae a non-exclusive, royalty-free, worldwide license to use it for service display and marketing purposes.
• You may request the removal of your submitted content at any time by contacting our support team.
• If you submit photos as part of your reviews, you confirm that you either own the content or have obtained the necessary rights to share it.
• By submitting such photos, which may include identifiable personal features (e.g., face, skin condition), you grant Hwahae a non-exclusive, royalty-free license to display and use them across its services and promotions.

Hwahae reserves the right to remove any content that violates third-party rights or applicable laws without notice. Repeated violations, such as the submission of stolen or unauthorized content, may result in account suspension or permanent restrictions. You are solely responsible for ensuring that your submission does not infringe on others' rights.

User Information Usage

• Hwahae may use non-identifiable user attributes (e.g., nickname, gender, age, country, skin type, skin tone, skin concerns, parental status) to personalize the service experience, enhance review context, and support promotional activities. However, Hwahae will never provide your personal information to third parties without your explicit consent.

Granting License for Review Content

By posting a review or any content, you grant Hwahae, its parent company, subsidiaries and entities under common control, and their respective licensees, successors and assigns a worldwide, perpetual, irrevocable, royalty-free, sublicensable and transferable license to:

• Reproduce, distribute, publish, and display your content within Hwahae services.
• Use your reviews for promotional, marketing, and new service development purposes.
• Leverage user-generated content for commercial and non-commercial applications under Hwahae's management.

Content Management and Compliance

Hwahae reserves the right to remove or restrict content that violates:

• Intellectual property rights (e.g., plagiarism or copyright infringement).
• Defamation laws (e.g., content that damages a third party’s reputation).
• Hwahae’s internal policies regarding review modification requests.

Unless a review violates these conditions, Hwahae will not arbitrarily delete or modify user-generated content within the platform.

Hwahae Points System

Hwahae may issue points as part of its rewards program. for:

• Purchasing products through the platform.
• Writing reviews.
• Participating in events or promotions.

Usage and Conditions:

• Points can be combined with other payment methods, subject to Hwahae’s operational policies.
• The amount, accumulation method, and expiration period may vary based on Hwahae’s internal policies.
• Points cannot be transferred, sold, or exchanged for cash under any circumstances.
• Points are used in the order of earliest expiration.
• Unused points will be forfeited upon account deletion.
• If a user obtains points fraudulently, Hwahae reserves the right to revoke them and impose service restrictions as necessary.

Hwahae’s Disclaimer of Liabilities

TO THE EXTENT PERMITTED BY APPLICABLE LAW, HWAHAE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SITES. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES.

Hwahae is not liable for damages caused by:

• Personal losses incurred during service access or usage.
• Unauthorized access or illegal activities by third parties on Hwahae’s servers.
• Disruptions caused by third parties interfering with data transmission to or from Hwahae servers.
• Malicious programs, viruses, or other harmful software introduced by third parties.
• Omissions, deletions, or corruption of transmitted data.
• Losses caused by sellers, advertisers, or other third parties using Hwahae services.

Additionally, to the extent permitted by law, Hwahae shall not be responsible for any indirect, special, consequential, disciplinary, or punitive damages arising from the use of its services.

Modifications to the Terms

Hwahae reserves the right to change or modify any of the Terms, at any time, without notice. If Hwahae decides to change these Terms, Hwahae will post a new version on the Sites and update the date set forth above. ANY CHANGES TO THESE TERMS WILL BE EFFECTIVE UPON POSTING AND WILL REPLACE THE PRIOR VERSION AND ARE APPLICABLE TO ANY FUTURE DISPUTES BETWEEN THE PARTIES. You should thus review these Terms periodically.

User Feedback on Changes

Continued use of the service will be considered as acceptance of the new terms.

If you do not agree to the updated terms, unfortunately, Hwahae may no longer be able to provide you with the affected services.

Indemnification

You agree to defend, indemnify and hold harmless Hwahae (and its officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers), from all claims, and damages including reasonable legal fees, arising from your misuse of the Sites,  your violation of these Terms  any Content you that violates any law or the rights of a third party. This indemnification obligation will survive the termination of these Terms and your misuse of the Sites.

DMCA

If you believe your copyrighted work has been used improperly on the Sites, please submit a Digital Millennium Copyright Act (the "DMCA") request with the required details to Hwahae’s designated copyright agent:

• An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
• A description of the copyrighted work that you claim has been infringed upon;
• A description of where the material that you claim is infringing is located on the Sites;
• A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
• Your name, address, telephone number and email address (if available);
• A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

Legal Considerations

• If you violate these Terms, and Hwahae does not take immediate action, this does not mean that Hwahae waives its rights to enforce them in the future.
• If any provision of these terms is found to be unenforceable, it will not affect the validity of the remaining provisions.

Dispute Resolution & Governing Law

Hwahae will strive to resolve any disputes amicably through mutual agreement. However, if legal proceedings are necessary, disputes will be handled in the court with jurisdiction over Hwahae’s headquarters, in accordance with the laws of the Republic of Korea.
